The RTA are quiet vague in what they state.
But basically anything that improves the engines performance. What that extends to or how far it extends has me beat.
It really is sloppy legislation.

vague legislation makes it easier for cops to pin us for something and just say "the law says..." it really is bullshit! but really, i could do things to my engine and just claim they don't increase performance i just did it for looks/sound/economy etc... my CAI for example (or yours for that matter)... might increase performance (however slightly) but it's more for economy, throttle response and the noise... or we could all just be dylan and drive a turbo anyway... lol

Well my question is, what performance are they measuring? The over all power/torque the engine makes? The over all efficiency of the engine? I mean, you can make an engine run better and use less fuel. You can also make and engine use less fuel and therefore create less pollution, but still only generate the same KW@W rating. So where in their legislation do they explain what constitutes a "Performance" modification? Is converting to gas a performance modification? As it increases the overall economic performance. But certainly does not improve power performance.

Man. It is not the Police officers responsibility to KNOW all laws, and how to apply them. It is disappointing that some RTA legislation can be interpreted different ways however ultimately it is the responsibility of the car owner to have the vehicle cleared by an authorised RTA checking station. So it's not that it makes it 'easy for cops to pin it on you', it's just your responsibility to ensure what you are doing is legal as far as the RTA is concerned.

all you need is to be law aware and when the police tells you its ilegal u need to be smarter then them and say its not the law states this and play the law in your favour not theres..thats how they do it....

Best bet is be polite and try to explain yourself clearly and calmly and also hope that the officer your talking to isn't a total d**k.

very true that, but also then if its not his job to know what everything means in the engenieers cert, he or she shouldnt be defecting cars? i think there should be qualified police officers who were mechanics or repairers once upon in there life or get an education in the field then start issueing defects, coz at this stage and its only my oppinion that every Tom d**k and Herry can issue defects on cars when they clearly have no idea as to what they are looking at.

Perhaps there needs to be some instruction give to police about what is, and isn't legal. Because i agree, there are some pretty outrageous calls. I doubt you'll get many ex-mechanic police officers though. In order to be eligible to join the police force in NSW you need to have put 200hrs towards a degree of some sort. Or so I've been told, by a Police officer mind you.

I doubt you'll get many ex-mechanic police officers though. In order to be eligible to join the police force in NSW you need to have put 200hrs towards a degree of some sort. Or so I've been told, by a Police officer mind you.



yes thats true they need a degree...and i know a mechanic who is a cop now but isnt looking at defetcs and stuff he is your normal everyday contstable i think...but i was talking to him about HIDs and LED parkers today and the legal aspects of it...and so far its not illegal to have either in nsw.

I doubt LED's will be illegal ever. I dare say they will become the norm over the coming years. HID's on the other hand, i dunno. 3am in the morning oncoming traffic with HID's shit me to tears.

Hids he said no info on legality yet so its a discretion of the officer i guess

regardless weather its projectors or normal lenses they are just bright...and a horrible for oncoming traffic and traffic infront of you...

I would have thought Projectors may contain the beam slightly better.

i have factory h.i.d.s with as you call regular headlights but they do have a height adjustable control for when there is extra weight in the rear this is so i dont blind on comming cars. not like some people out there whop dont know how to correctly adjust them down
