it looks like he can race, not necessarily will. a team being forced to use a driver they don't want sounds more like one less car starting the race on the weekend to me. take them to court twice when they clearly don't want you as part of the "team" sounds like a pretty stupid strategy to get yourself a drive imo

"Giedo van der Garde says he is "looking forward to getting back to business" after an Australian court ruled in his favour on Wednesday.
The Dutch driver was left without a race seat for 2015 after Sauber opted for a line-up of Felipe Nasr and Marcus Ericsson, but Van der Garde took legal action and a Swiss arbitration court ruled that the team should hand him a seat.
Sauber appealed the decision, but the Supreme Court of Victoria upheld the Swiss court's decision saying that the ruling applies "to the whole of the 2015 Formula 1 season - not just in relation to the coming few days in Melbourne for the Australian Grand Prix".
The Hinwil squad, though, will continue their fight and their latest appeal will be heard on Thursday morning.
Van der Garde, though, is already focusing on getting back in the car and racing at Albert Park this weekend.
"I'm very happy with the outcome. I'm fit and very strong and I'm looking forward to going back to the team and doing the best we can," said Van der Garde.
"I’m as fit as ever, I’ve been training for the last three months flat out."
He added: "I had a very good relationship with the team and I still have a very good relationship with the team. I’m looking forward to racing this weekend. I’m happy we won the case and now I’m looking forward to getting back to business."
Is this guy off his head?!? Back to court tomorrow for Saubers second appeal and this guys thinks they're all still buddy's

its such a ridiculous situation all around as technically he does have a driver contract with them. the pay driver business model that many of the mid/bottom base their sustainability around is a real blight on F1 (especially sad when a team with as much heritage as Sauber needs it to survive). Unfortunately it looks like there would be no F1 without it at the moment.
they need to get Toyota and Honda back in as manufacturers and convince Volkswagon (or under one of their other banners) to join and run three cars per team.

Aparently Giedo has paid up to (believe that with a grain of salt) 80 million euros for his seat for two years. Nasr and Ericcson have both also paid for a seat this season so whatever happens, Sauber are up the creek. How Monisha let it get to this you've go to wonder??
"Lawyers for Formula One driver Giedo van der Garde have called for Sauber Motorsport to be found guilty of contempt of court for stopping him racing in Sunday's Australian Grand Prix.
They also want the team's principal, Monisha Kaltenborn, fined or jailed for defying a ruling that the Dutchman be reinstated for the season-opener in Melbourne.
Van der Garde's lawyer Jim Peters QC told the Victorian Supreme Court Sauber's lawyers sent an email at 11:59pm on Thursday claiming van der Garde's contract had been terminated lawfully, so it could see no reason why it needed to write to the FIA's contracts recognition board to reinstate him.
Mr Peters said Sauber was therefore blocking van der Garde from getting the required Super Licence.
"Sauber simply refuses to complete the paperwork," he said.
"All Sauber has to do is sign the form.
"Sauber's taken the position that it will continue to prevent Mr van der Garde from getting a licence to drive by refusing to recognise him as one of the nominated drivers."
Van der Garde claimed he was guaranteed a seat for the 2015 season, but was dumped in favour of Swede Marcus Ericsson and Brazilian Felipe Nasr.
Mr Peters said the court should order the seizure of the Swiss team's Australian-based assets until the ruling was complied with.
"Time is of the essence in this matter," he said.
"Sauber will leave the jurisdiction on Monday and one of the orders we seek is sequestration today or tomorrow of the racing equipment.
"The need for expedition is great, otherwise our entitlement to relief will be lost."
The hearing has been adjourned until Saturday.
Sauber did not take part in the first Grand Prix practice session at Albert Park."
