When it comes time to dismiss them due to performance/lateness, he needs to have his ass covered legally.

Written warnings are a must when it comes to claiming work performance problems.

Ugh i could ramble on for forking days about this stuff.

You exchange contracts, then have a 5 day cooling off period, in which the docs are signed, and sent back and a letter of unconditional approval is provided to the real estate.

Have you not exchanged yet? Have you put a holding deposit down?
