15 hour day for me Zac, but that is normal for Wed/Thur/Fri and at the moment Tuesday as well.

This was interesting, I knew this stuff anyways but I bet there are a lot of people who don't.

This is true... well we have an oven in the kitchen at work...

 

15 hour day for me Zac, but that is normal for Wed/Thur/Fri and at the moment Tuesday as well.

This was interesting, I knew this stuff anyways but I bet there are a lot of people who don't.

True... but you aren't stuck in an office behind a computer for 15 hours... plus, I don't get paid overtime... you get paid for your hours worked...

 

Oh well... blah... need something good for lunch, but have an interview instead... will have to grab something quick on the way back to work after...

When determining whether additional hours are reasonable, the following factors are to be considered:
  1. any risk to employee health and safety from working the additional hours
  2. the employee’s personal circumstances, including family responsibilities
  3. the needs of the workplace or enterprise in which the employee is employed
  4. whether the employee is entitled to receive overtime payments, penalty rates or other compensation for, or a level of remuneration that reflects an expectation of, working additional hours
  5. notice (if any) given by the employer of any request or requirement to work the additional hours
  6. the notice (if any) given by the employer of his or her intention to refuse to work the additional hours
  7. the usual patterns of work in the industry, or the part of an industry, in which the employee works
  8. the nature of the employee’s role, and the employee’s level of responsibility
  9. whether the additional hours are in accordance with the averaging terms of the modern award or enterprise agreement that applies to the employee, or with an averaging arrangement agreed to by the employer and employee under s64 of theFair Work Act
  10. any other relevant matter.
The hours of work an employee works in a week are taken to include any authorised hours of leave, or absence, whether paid or unpaid, that the employee takes in the week.

Strictly speaking, a 15 hour work day is illegal in Australia. I think the closest you can go is 14 hours, which is the maximum 12, plus a mutually agreed hour before, and hour after. The extra hours cannot be considered concurrent, but how they'd ever know whether you started early or not to achieve the hour bank, I am unsure.

 

So in the way the hours are are spread across the 38 hour week is more important than how many hours one does in a single day. If you do 5 hours tomorrow, it would be considered pretty close to reasonable as works being undertaken are related to putting further work into production.

Think I've worked 22 hours at work before... and because they were so nice to me, they gave me half a day off the next day... lol... 

 

I'd rather the extra money if I was working stupid hours like that...

I don't care about me, I'm just trying to give some light on the situation from an employer/legalese perspective. Sometimes you can tell the story as facts alone and it sounds like a great injustice of the world, but if it is well within the law, apart from being upset about it - there really isn't anything fair about attacking your employer.

 

Not that Isaac is doing it, just I've spent a lot of time on FairWork issues, and I think it's important to know that there is two sides to this coin.

 

Which is one of my biggest problems with 'FAIRwork' - it really solidified an US versus THEM mentality back into the workplace, typical Labor unionistic ideallogy.

Nope... not blaming my employer... work needs to be done, and the release has to happen after hours... just stating that is is going to be a very long day, and if shite does hit the fan, then I won't be going home at all till maybe tomorrow arvo...
