Do they have it any on board footage of you doing any of the such? They still need proof that you were doing such a speed... once upon a time on my p i got "estimated" doing 110 in a 70 zone when I was actually doing 80, took it to court got my lawyer to get onboard footage n estimated from that n it got down graded to only 10 over instead 40 n of loosing my licence

If you go for your blacks before you have paid the fine, You will be pulled up while filling out the form.

One of the questions asked is: Do you have any demerit point/fines that haven't been processed yet?

If you say no and get away with it, You get stung with a fine and lose your blacks for the same amount of time as they stung you when you were a p plater. Because the incident happened on p plates.

Suck it up, Take it to court and maybe get a bit of time taken off the suspension.

I said "No" while I still had 2 (red light and speeding) fines at the SDRO, didn't get pulled up for it, got my Full license, 3 months on still have license... I always thought the RTA where not notified of your demerit points being added until the SDRO processes your payed fine... Or I could just be lucky (Also cops when they key in your license number for a license check, can't see any pending demerit points)

Sucks about all the fines mate. At least they didn't go over your car and try and defect you for something as well.

You don't get a letter, you just have to go off the date on your licence.

There is no letter. You should know when you're eligible... I know I was counting down the days!

I was sure I was eligible in January, wasn't sure on how I could check.
I've since found out that I was already eligible.

I'm not suspended luckily.
I lost a total of 6 points and P2's have 7.

It was highway patrol so they told me they had footage and everything was recorded (inc. the conversation, not sure if the conversation was video recorded too?)

When you get your blacks you get your full demerits back anyway.

Take it to court. If you let it stand you cop a 6 month suspension. End of story. Not displaying P plates is a breach of conditions and they will suspend your licence. Blacks or not. Date of offence is what they go off, not what licence you happen to hold. Been through this before. Spent 5 years on P plates because of it. If you can fight it, do it.

What a load of shit. Fight it. They've got nothing on you apart from not displaying P's. They can't target two cars with their radar so their guess at your speed doesn't apply.

simply, they have no evidence. They have taken advice from someone (the supra driver) who has nothing to lose by pointing the finger at you.

cops tried this on me once. I thanked them for their time and told them.to chase me for a fine ir proof and drove off. They are just being *****.

In wa hwp do not need radar or footage they are qualified to estimate speed which holds up in court.

I've never heard of anything like that in NSW Chamillionaire... Unless they are traveling behind you they can estimate it, but not when stationary.

they can estimate in NSW but it may or may not hold up if challenged in court. they will generally try and trap/trick you into admitting you were speeding when they book you so they have it on recording. i challenged one by mail and got off many years ago (so my info my be out of date as that was over 10 years ago lol)

That's what I was thinking.. When they came and talked to you after the Supra, I wonder if you said anything that would pin you?

The police are going off what the supra driver has told you, and not what they have seen themselves, which is blatant hearsay and cannot be used in any court of law, he said she said is not allowed, as it can just easily be made up on the spot. cant use it in court p, nor should they be able to charge you without having actual evidence. All it is is one word against another with no evidence to back either side up. Take it to court and you can easily get those two charges dismissed by a judge then and there. Would also be a good chance he would throw out the speeding as well given the circumstances.

Im not sure if things have changed guys but my old man was a copper for 37 years and has told stories about estimating speeds and winning in court. The fact that he estimated your speed before he spoke to the supra about tailgating and high beams means it was his own judgement call.

You can take it to court to fight the charges but fact is he is a copper and when it comes down to his words vs yours, 99% of judges will take the cops word. Otherwise it sets precedence for everyone else. Been here, personal experience got clocked rolling down a hill coming into 110 zone at brooklyn bridge. perfect history and still copped (from memory) $155 fine plus court fees (approx $100). Also if you take this to court, they will record that and if something more serious comes up which could possibly be a license suspension, they wont let you off twice.

Yes it sucks and there are some real arsehole cops out there but i reckon pay it and move on. Best of luck either way mate.

With the cop estimating the speed wether that will hold up in court will also depend on the experience of the copper. They are more likley to convict with a cop with 20+ years of highway patrol experience behind him then a young copper with 1 or 2 years on the job.

Haha, I think.. some people have misunderstood the whole point.

I was few hundred metres behind the supra which was clocked at 87KM p/h that's how my speed was estimated.
The cops simply asked me if I was tailgating the supra I just said no, it's bullshit and that was the end of it.

I'm lucky the cops didn't say that I was 20 and over if that's what they caught the Supra doing.
To be honest, I have no idea what speed i was doing It was down a hill.. I didn't think it was that fast.

I'm just happy that I still have a license and able to drive to work otherwise i'd loose my job.

I'll be getting my full license very shortly and I'll have more points up my sleeve.
I wasn't asking anyone how do I get off the charges, my old fella is a lawyer and deals with this everyday.

I know cops try to trap you into admitting that you were speeding, but I am Samwise Gamgee and I know these witchcraft tricks and I didn't say anything. The police asked me any reason for your speeding tonight and I just handed my license over and didn't reply he then asked me if it was turbo'd haha I said, nope.
Then he checked for my P plates and told me that I didn't have any, I said.. I know.
I told him I'd just been to a 21st and then he asked me if I had been drinking and I obviously said no but strangely, no breath test.

The cops were pretty decent about the whole situation.
