Yeah I wasn't quite sure of the specific hours. But most of the time we have say we have our break before we actually do on the timesheets. But i thought it was 5 hours? Might be different over here. And we never take paid breaks. It doesn't seem right to me, in any case.
It has a bit to do with whether or not the break is rostered. I don't roster breaks for this very reason, not because it's cheaper for me, it just makes sense for everyone - once you sit down to eat your sandwich you don't want me bursting through the door saying "we're getting slammed, please come and help" (may or may not be that polite)
If your hospitality employees can’t take their meal break at the arranged time (for example if your business is very busy at the time they are rostered to take their break), the employees must be paid an additional penalty until they are able to take their break or until their shift ends.
If there was no arranged time for the break, the employees must be paid the additional amount from the end of 6 hours until they are able to take a break or until their shift ends.
