11% of normal pay rate. It's 17.5% in hospitality and retail as far as I can see.

So what. You mean I should get 17.5% of all my annual leave that I was paid out?

17.5% on top of your owed annual leave.

Sort of makes sense. Still not sure what I'm entitled to.

How much annual leave you are owed + a 17.5% loading, mate. But don't include any penalty rates, and if you were being paid above the award, most employers will load from the actual award rate.

Right. So it sounds like he has paid the leave loading but not the final annual leave.

Well it should be fairly easy to work out, how much leave had you accrued?

Don't take me as gospel, by the way. I won't say anything unless I'm confident in it, but do remember that FairWork is just as much of a mind Posted Image

108 hours. It was being paid out over 3 fortnights. 20 The first then 44 each fortnight after that.

18.9 hours at award rate is your loading then.

Mine is 0%

So is mine.

I work 4 x 12hr shifts over a rotating 8 day week.
No loadings what so ever for public hols and no designated meal break.

Big companies find legal loop holes to do as the see fit.

My boss is a legend though. He told me to take 2 days off paid so a casual employee could have some work

Just got an email back from him. This is what he says:

Yes that is correct

That is the remaining annual leave hours. and leave loading wasn't an entitlement as you haven't been with us for 1 yr.

According to the award you weren't entitled to annual leave unless you have worked for 12 month with us, so you got the good end of the straw.

This is the final termination payment, all entitlements have been paid plus some. I added an extra 8 hours on the annual leave to make it easier, which I didn't have to do.
