Smallest you can legally keep (in QLD atleast) is the aussie painted turtle. But they are the hardest to keep also, and expensive. I want one someday. EDIT: Checked, its the Macleay.

 

@bumpty, basically you would need a license. I have to sign him over to you and tell the authority here, then you'd do a similar document for where you're from. But I doubt you can just throw him in a dam haha. Not in winter anyway, they're supposed to be hibernating atm. He's an indoor turtle that would need to be introduced slowly to a pond over summer. Would have to fence it off too unless you only want to see him for a short time. They eat fish, cray, shrimp, worms, insects and live plants (short necks eat plants). I feed mine some dried food also. So yeah, probably easiest to just pick one up locally. If you have dams you may already have some and not know it :P

Oh right. I think its actually illegal to have turtles there regardless. Unless you have a zoo license.

Finally changed battery, believe it or not Josh's plan would've been simpler. It's fcuking midnight.
