Regardless of what has happened prior to the "slippering" when a person is on the ground being kicked, it is no longer legally defined as a case of common assault.
Any person who is in the process of or displays the ability and intent to cause serious injury and perhaps death may be stoped using a reasonable level of force.
Having said that.... What is reasonable force?
Police & Security officers follow a "Force continuum" which basically is a recommended response to the threat being displayed. This also applies to a basic citizen and legal interpretations of what is reasonable or acceptable force to stop a person in the process of commiting a serious indictable offence.
To simplify....
If you are being punched you may punch back in defence.
If the person arms themself with an object you may arm yourself with a bigger object.
If they have a knife you can pull a gun etc etc
I'm not mentioning this to say you shoulda done this or you should of done that. More so to make people aware that you do have some rights when it comes to protecting yourself and family.
You would not be charged with an offence if your intention is only to stop a person in the process of committing a crime.
Only problem with that is.... say you hit him with a chair.... what would his friends have done then?
